After a fatal New Jersey crash in 2019, a professional boxer, Bobby Gunn, faced a seemingly insurmountable challenge against a litany of criminal charges raised by the State of New Jersey. Gunn’s attorney, Michael Grasso, hired GLFE’s Dan Billington to conduct a collision reconstruction. While pouring over the evidence, Mr. Billington found that the state had lied to the defense when they told Gunn’s counsel that the vehicle they seized had been released and destroyed prior to giving the defense a chance to inspect it. Despite the State’s claim, Mr. Billington found that the vehicle had not only not been destroyed, but that it had been sold at auction, repaired, and was currently registered in the State of Texas. Facing their own insurmountable battle of prevailing in a spoliation motion, the State agreed to reduce the charges, seeking only probation.
